>> good morning, everyone. it's thursday, october 4. i'm michelle griego. >> hi, everybody. i'm frank mallicoat. it is 5:00 on the nose right now. president obama and republican challenger mitt romney head to key battleground states today after having their say at their first face-to-face debate. an exclusive cbs 5 surveyusa poll of adults in california shows that 48% believe romney won compared with 34% for president obama. 18% felt there was no clear winner. last night's forum in colorado focused mainly on the economy and other domestic issues. that debate took place at the university of denver, colorado being a big swing state in this election, as well. the focus of the debate was the economy. but big bird somehow got into the dialogue there. and, of course, as we mentioned, there were some polls that showed that romney came out ahead of the president on that first debate. bigad shaban joins us live from denver with some highlights from last night.

[ pause ] >> reporter: good morning. it seems mitt romney may have got the boost he was hoping for after putting the president on the defensive all night. romney you wanted to his own successes as massachusetts governor but highlighted what he called the failed promises of the obama administration. reporter: the first presidential debate started with a handshake and a romantic moment. >> 20 years ago, i became the luckiest man on earth because michelle obama agreed to marry me. >> congratulations to you, mr. president, on your anniversary. i'm sure this was the most romantic place you could imagine here with me. >> reporter: the theme of the debate for president obama appeared to be that romney's plans lacked specifics. >> is the reason that governor romney is keeping all these plans secret because it's too good? >> reporter: governor romney spent the night attacking his record. >> you have been president for four years. you said would you cut the deficit in half. it's now four years later. we still have trillion dollar deficits. >> reporter: mitt romney came into the debate trailing in the

polls but that could change after last night's performance. >> anytime a challenger stands on the stage with the president in a first debate they tend to get a bounce. i expect that could happen here. >> reporter: the romney campaign believes the governor scored a knockout. >> i believe that governor romney was the clear winner of this debate. if it was a boxing match it would have been called. >> reporter: an instant cbs news poll chose romney the overwhelming winner. 46% of the people we surveyed said romney won the debate. but moderator and pbs anchor jim lehrer might not feel the same way. >> i'm sorry, jim, i'm going to stop this subsidy to pbs. i'm going to stop other things. i like pbs. i love big bird. i actually like you, too. but i'm not going to keep on spending money for things to borrow money from china to pay for it. >> reporter: they will square off again october 16. the vice-presidential candidates will soon get their chance. their first and only debate is set for next thursday. in denver, i'm bigad shaban.

a man shot here on doe burn avenue died on scene. i just spoke with one of his friends who was standing with him a small group of people standing together near a home. they said they were hang out playing some reggae music when four people came up and one of them opened fire. >> we're not sure if this is gang-related. we're looking into that angle. all we know is a family was gathering and a person was shot and died. >> reporter: the san jose's 35th homicide of the year happened a few hours earlier two blocks from san jose state in downtown san jose on south second street at around 8:30 p.m. police say there had been a fight when they got there a man was unconscious and not breathing. he was taken to the hospital where he died. now, police are not releasing these people's names. the friend also did not want to release his friend's name. he said that the people who came upon this small party here last night all had masks on their faces and so it is going

to be difficult to identify the shooters. live in san jose, anne makovec cbs 5. a rush hour confrontation tied up caltrain service around the diridon station in downtown san jose. a san mateo county sheriff's deputy on patrol for caltrain found a 29-year-old san jose man acting strangely and laying on the tracks. the deputy followed the man down the tracks and then called for backup. investigators say the man armed himself with some rocks and possibly a railroad spike. >> the suspect displayed some type of threatening behavior toward the officers that the san mateo county sheriff's deputy believed was a danger to his safety and that of the other deputies and he fired several rounds at the suspect. the suspect was struck twice. >> the suspect is expected to face assault charges when he is released from the hospital. this morning vallejo police are investigating the deaths two of men in a enabled dispute. neighbors on folkstone way reported hearing several shots

about 6 p.m. last night. police say it appears one neighbor carrying a firearm crossed the street to confront the two victims in a driveway. neighbors then heard six to eight shots. the suspect, 65-year-old martin hoheneger was arrested. troubling, that's the word used by a court-appointed monitor about oakland police for the "occupy" oakland protestors. they were said to be unprepared for the reoccupation. he said they will watch carefully to see if the department makes recommendations. 5:06. let's check traffic and weather. lawrence is off today. >> i was hot in the morning and in the afternoon it was cold. we got that sea breeze moving into the bay area bringing these coolers temperatures so we are only seeing 50s out the door now and these afternoon

highs not going to warm up by much. so if you thought it was cooler yesterday, we are going to see even more dramatic difference by later on this afternoon. here's the temperature difference compared to yesterday. these highs this afternoon are going to be 10 to 20 degrees cooler depending where you are in parts of bay area. check the difference in livermore. 14-degree difference. mid-90s yesterday no longer the case today. we are only going to see low 80s in our inland areas and the rest of the bay only going to be about 63 degrees in san francisco. so this cooling trend continues into the weekend. we'll show you a look at your seven-day forecast coming up. in the meantime we're hitting the roads with gianna. >> thank you. we are getting first reports of some major bart delays. this is due to a maintenance vehicle stuck on the tracks happening at the oakland station in the fremont millbrae directions due to the disabled vehicle stuck on the tracks. no word when they will clear it. but again, this is going to be a very busy day for bart. we have a lot going on this weekend here in san francisco

the vehicle. they are starting to move trains through the area but again, that's going to take most of the morning to get things right back on track there. again expect major delays right now possibly up to an hour. of course we'll continue to keep you updated. the good news is the rest of mass transit is on time. ace, muni, caltrain, ferries, no delays on the freeways now. so if you are taking your car instead of bart you will be okay so far, so good on the roads. just keep in mind later on it is a busy weekend in san francisco. we have a lot going on with fleet week, america's cup, also closures at howard and 3rd so you're going to see extra busy conditions this morning as well as throughout the day and through the weekend. so just keep that in mind if you plan on using bart later on today. hopefully though things will get back on track. elsewhere we have some roadwork westbound 92 ramp to southbound 280 still in effect. also roadwork on the dumbarton bridge. good news there everything has been wrapped up. south bay looking good they delays 101 clear to 80. guadalupe parkway cruising right along. live look at milpitas. so far, so good. no delays on the roads through

there. also the golden gate bridge holding steady with a 13-minute ride to go south 101 from 580 to the golden gate bridge toll plaza. let's check the bay bridge toll plaza. you can see traffic cruising right along with no problems through there but we'll continue to keep you updated on the situation with bart. right now let's check weather with elizabeth. >> thanks, gianna. the biggest temperature difference -- the biggest weather story today is the temperature difference. it's going to feel cooler. so finally starting to feel like fall and temperatures out the door mainly in the 50s and low clouds and fog start you off, as well. partly cloudy skies inland. highs there 59 degrees. this afternoon we are going to warm up mainly in the 60s along the coast and bay and then we'll see 70s to very low 80s in some inland spots. so if you thought it was cooler yesterday it's going to feel even more dramatically cool today. it's because of the sea breeze kicking in low pressure off the coast and this is really just the beginning of this cooler weather. it's going to continue into saturday, sunday and then we

are even keeping a slight chance of rain in the forecast for monday. we'll show you the seven-day forecast in just a minute. in the meantime here's your forecasted highs. later on this afternoon once again you will see a lot of 70s so a lot of yellows and greens in our color-coded guide. warm in antioch and brentwood where it's usually pretty warm low 80s there. 77 walnut creek. and otherwise, along the coast, no longer beach weather for folks in bodega bay, stinson beach, only reaching into the upper 50s to low 60s there. then we're seeing a lot of 60s around the bay. 62 degrees in richmond, 64 berkeley. highs for the next several days, you will see a cooling trend in effect through saturday and sunday. we're only going to reach into the 70s by this weekend and then monday once again, it's going to be a cloudy start to the workweek and we're keeping that about 20% chance of rain in the forecast for now. all right. that's a look at weather. back to you guys. >> thank you. s. in world news this morning, turkey is firing on targets in neighbor syria for a second

straight day. it's in response to heavy shelling from syria that killed five civilians in a turkish bordertown. that artillery appeared to come from syrian government forces trying to outst the regime of president assad. tens of thousands of syrians are fleeing to turkey to flee the violence. there were 13 threats against the embassy in benghazi before the attack in september. that's what a committee said it was told by a state department officer. a committee will hold a hearing next week on the growing controversy over the attack. a new book says president obama had wanted to put osama bin laden on trial to demonstrate the u.s. commitment to due process under law but that was if bin laden had surrendered during the raid in which he was killed. the book by journalist mark bowden entitled the finish is due out october 16. 5:19 now. we'll find out in about 10 minutes how many americans are

signing up for jobless claims. this morning, the labor department releases the weekly report on new jobless claims. tomorrow will gives the september employment report. yesterday a private payroll company said u.s. businesses added slightly more workers than expected last month. it appears the star of the show punked was the target of a hoax. >> police swarmed ashton kutcher's hollywood hills home yesterday after a report of a break-in and shots fired. someone contacted police claiming there were men with guns inside the home. officers searched the house but only found three workers hired by kutcher. police suspect it was a case of swatting someone trying to get the s.w.a.t. team to respond. >> not good. 5:20 right now. the underdogs are on top this morning. how the oakland as overcame a big deficit to win their division. >> they finally got a day off after quit a week. plus the brilliant bicycle kick that's earned the play of the day. we're talking soccer when we come back.

most on twitter after the debate? the big bird comment. >> i know. >> you know. they always pick out the little things. let's have weather and traffic. the fog came back and the cooldown commenced. >> it has. even cooler still by the weekend. we are not seeing a lot of the low clouds and fog around the bay. we can see the bay bridge toll plaza out the door right now but, yeah, you will notice some fog especially around the coast and some of our inland spots and yesterday you will notice it is a lot cooler today dramatically so compared to yesterday. so temperatures mainly in fact 50s a few low 60s. 60 now in oakland. otherwise san francisco, livermore coming in in the upper 50s. so yeah, by this afternoon, these highs no triple digits. we're pretty much done for this season. it's just a downward trend through winter from here on out. so in the south bay we're mainly going to see 70s. we'll see some 80s east of the oakland hills so antioch going to reach a high of 80. 81 in livermore and 77 degrees in walnut creek. so a little more comfortable

for folks there. otherwise, central bay pretty cool only reaching into the 60s. 65 in alameda. and 63 is your forecasted high in san francisco. so coming up a check of your seven-day forecast. we are putting a slight chance of rain in that so we'll tell you what day that's forecasted. in the meantime, we're talking traffic and big bart delays with gianna. >> there are major bart delays continuing throughout the morning. in fact, i just got off the phone with bart. it happened because of a disabled maintenance vehicle that got stuck on the tracks between 19th street and macarthur so this originated in downtown oakland. they removed the vehicle from the tracks. they are single tracking trains through the area. at one point the delays were only affecting the richmond to sf trains and bay point to sf but now i'm learning that the delays are going to be systemwide until they can get everything back on time so we're hearing up to an hour possibly so give yourself some extra time. you might want to drive in if you have to be into san francisco within the next half hour at least for right now major bart delays continue. the rest of mass transit is on time of the muni, ace,

caltrain, ferries, everything is work and no reports any of troubles on the freeways. that's a look at traffic. back to you guys. >> thank you. 5:37 now. some developing news in san jose where police have two overnight murders to solve now. cbs 5 reporter anne makovec in east san jose where police are still at the scene of the city's latest homicide. anne, good morning. reporter: this is san jose's 36th homicide of the year here. i spoke with a man who saw it all go down. he said that they were about 10 people hanging out having a birthday party in front of a home here about 12:30 a.m. playing reggae music when suddenly, a group of about 4 people wearing blue rags on their faces ambushed them and one started shooting hitting a man who was somewhere around 30 years old. that man ran into the house screaming and he died here on scene. police think this may be gang- related. but the friend of the man who died said no one at the party was affiliated with a gang. >> all you hear is about three

good morning. welcome back. we are monitoring bart delays due to a stuck maintenance vehicle on the tracks in oakland. we have jim allison joining from us bart. jim, can you tell us what things are like right now? >> we still have major delays. but the maintenance vehicles have been moved off to the side so we are using both of our tracks. it's a matter of moving more slowly through that area now due to the maintenance vehicles there and getting rid of the train congestion but we should be back up and running full speed as the morning commute progresses. >> do you have any estimated time when that will be? when you say major delays, what

kind of time frame is that? >> well, it's essentially up to 20-minute delays into san francisco from the east bay right now. but within the next 20 minutes or so, once we get the train congestion cleared up, we hope to be back on schedule. >> okay, jim, thank you so many for joining us. so again, bart delays continue this morning but as you heard, hopefully within the next 20 minutes things should be wrapping up. the good news there are no major freeway problems. bay bridge and golden gate bridge look good. roadwork this morning paving work southbound 101 from sir francis drake to rodeo avenue may slow you down a bit this morning. once you hit the golden gate bridge things are quiet. looks like antioch loading up westbound 4 through there. clear once you hit the eastshore freeway. that's a look at your morning drive. here's elizabeth with a look at your forecast. >> yeah. grab a jacket if you are about to head out this morning. these are your weather headlines. the big story how much cooler it will be. we have low clouds and fog especially around the coast and then by this afternoon, some

areas will see sunshine. a lot of areas especially inland but cooler temperatures and then even cooler still by this weekend. so yeah, beginning of a cooling trend, why? because of this low pressure system just off to our coast. sea breeze kicking in. i noticed it was breezy in san francisco yesterday. breezier still by later on this afternoon. if you are doing any traveling around northern california, central valley -- central valley will be hot. eureka cloudy skies, 58 degrees. elsewhere a little closer to home around the bay area, so yeah, temperatures only going to be in the 70s for the most part in the south bay. you see some 60s around the coast, half moon bay going to be 63 degrees. a chilly 62 degrees out in pacifica. earlier this week they reached into the 90s. so yeah, not the case any longer. we're going to see a real dip in temperatures. even antioch, brentwood, the low 80s in some parts there. it's going to be more comfortable if you are in walnut creek and concord, going to reach into the upper 70s. and then 60s for the most part

around the bay. let's see, 64 in berkeley and 65 degrees if you are in alameda. checking the forecast, over the next several days, it's going to be pretty much similar story for tomorrow. and then cooler still for saturday and sunday. yeah, even our inland spots are only going to reach into the mid- to upper 70s. if you can believe it by monday for the start of the workweek, we are going to put a chance of rain -- at this point it looks like a slight chance about 20% and anything we do get is not going to be much but still, rain. we haven't talked about that in quite a while. that is a check of traffic and weather together every 10 minutes. back to you guys. how about your oakland as? they come from four runs down to beat rangers 12-5 in the division winning game yesterday afternoon in front of a sellout crowd only the second of the year. the as swept texas to finish a historic late season surge. they won the last six in a row clinching home field advantage in the first roun of the play-

12, nasdaq up 15. on wall street we're seeing storm futures move higher as the jobs report came out the weekly jobless claims up slightly 4,000 to 367,000, actually better than what analysts were estimating that it would come out as. tomorrow we'll get the big monthly jobs report from the government that will be out at 8:30 tomorrow morning. one market loser was hewlett-packard. shares of hp fell 13% to their lowest level in 10 years after ceo meg whitman said she expects the company to continue to struggle over the next few years. whitman says it could be 2015 before hp's revenue growth picks up. the company is coming off the biggest quarterly loss in its history. again, guys, tomorrow with the big monthly jobs report, that will certainly move the markets tomorrow. >> we'll be taking a look at that. all right, ashley, you and i are facebook friends so apparently i can shell out a little money to get at the top of your news feed? >> reporter: yes.
